Terms of Service

These Terms of Service ("Terms") govern your access to and use of affinityhvactraining.com and the training services offered by Affinity HVAC Training ("Affinity HVAC Training," "we," "us," or "our") (together, the "Services"). By creating an account, purchasing a package, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Services. The Services are intended for HVAC professionals and others pursuing professional development.

Your account

To purchase or access training, you must create an account with accurate, current information. You are responsible for keeping your password confidential and for all activity that occurs under your account. Accounts are for individual use and may not be shared. Please notify us right away of any unauthorized use of your account.

Packages and access

• We offer training "Packages" (currently Residential and Commercial). Each package is a one-time purchase that grants access to that package's materials — including modules, quizzes, tests, and any included live monthly Zoom sessions — for 60 days from the date of purchase.
• After 60 days, access to that package ends. You may purchase the package again to regain access.
• The specific content, number of modules, and session schedule may change over time as we update and improve the materials.

Invited and complimentary access

We may grant access through invitation codes or partner referrals, sometimes at no charge. Complimentary or invited access is subject to these Terms, is non-transferable, and may be modified or revoked if it was issued in error or if these Terms are violated.

Pricing and payment

Prices are shown in U.S. dollars and are charged at the time of purchase through our payment processor, Stripe. You authorize us, through Stripe, to charge your selected payment method for the package you buy, plus any applicable taxes. We may change prices at any time, but a change will not affect a purchase you have already completed. Purchases are one-time charges — we do not offer subscriptions or automatic renewals.

Refunds

Because packages provide immediate access to digital training content, purchases are generally non-refundable. If you were charged in error, or you have not accessed any of the package materials, contact us at troythenewman@gmail.com within 7 days of purchase and we will review your request. Approved refunds are issued to the original payment method.

License and acceptable use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the course materials for your own professional development during your access period. You agree not to:

• share your account or access credentials with anyone else;
• copy, download (except where expressly provided), record, reproduce, resell, sublicense, distribute, or publicly display the materials;
• use the materials to build or support a competing product or service; or
• attempt to gain unauthorized access to the Services, other users' accounts, or our systems.

We may suspend or terminate access that violates these restrictions.

Intellectual property

All course content, text, graphics, images, videos, quizzes, tests, and other materials on the Services are owned by Affinity HVAC Training or its instructor and are protected by intellectual-property laws. These Terms do not transfer any ownership rights to you.

Educational disclaimer

Our materials are provided for educational and professional-development purposes. While our courses reference the 2021 IRC and related codes, they are not a substitute for the official code books or for the requirements of your local authority having jurisdiction (AHJ). We do not guarantee that completing a package will result in passing any exam, earning any certification, or meeting any specific licensing or code requirement. Always consult the codes adopted in your jurisdiction and the applicable authorities.

Live sessions

Live monthly Zoom sessions, where included, are offered on a schedule that may change. We are not responsible for problems caused by your internet connection or third-party conferencing software. Participants are expected to behave respectfully, and we may remove anyone who is disruptive.

Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Affinity HVAC Training and its instructor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the package giving rise to the claim during the 12 months before the claim.

Termination

You may stop using the Services and request account deletion at any time. We may suspend or terminate your access if you violate these Terms or misuse the Services. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will continue to apply.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and we may communicate material changes by email or a notice on the Site. Your continued use of the Services after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Colorado.
